Terms of Use

These Terms of Use ("Terms") govern your use of the Lexi-Defense application for Android and iOS ("Lexi-Defense" or "the app"), made by Gelotto ("we," "us"). By downloading or using Lexi-Defense you agree to these Terms. If you don't agree, please don't use the app.

1. License

We grant you a personal, non-exclusive, non-transferable, revocable license to download and use Lexi-Defense on devices you own or control, for your own non-commercial entertainment. If you got the app from Apple's App Store, Apple's standard Licensed Application End User License Agreement also applies; if you got it from Google Play, the Google Play Terms of Service also apply.

2. Game progress

Your progress, scores, achievements, and settings are stored only on your device. We don't keep a copy, so we can't restore progress lost by uninstalling the app, clearing its data, or changing devices.

3. Words and definitions

The word list and definitions come from Wiktionary via the kaikki.org extraction and are used under the Creative Commons Attribution-ShareAlike 4.0 license. Definitions are shortened and may be incomplete or inaccurate; they are provided for fun, not as a reference. We filter out offensive words, but no filter is perfect. If you find one that slipped through, please tell us at admin@gelotto.io.

4. Acceptable use

You agree not to reverse engineer, decompile, or modify the app except as permitted by law; not to use the app to infringe anyone's rights; not to redistribute or resell the app; and not to interfere with the app's operation or its distribution through the app stores.

5. Intellectual property

Lexi-Defense, including its code, design, artwork, level designs, sound effects, and name, is owned by Gelotto and protected by applicable intellectual-property laws, except for third-party content used under license (the Wiktionary word list and definitions, and the "Tower Defense 8-bit Chiptune" music track by nickpanek via Pixabay). These Terms do not grant you any rights in our trademarks or branding.

6. Privacy

Our Privacy Policy explains what the app collects and how to opt out of anonymous usage statistics.

7. Updates

We may release updates that add, change, or remove features, levels, or words. Some updates may be required to keep using the app.

8. Disclaimer of warranty

Lexi-Defense is provided "as is" and "as available," without warranties of any kind, express or implied, including fitness for a particular purpose, merchantability, and non-infringement. We don't warrant that the app will be uninterrupted or error-free, or that any particular word will be accepted.

9. Limitation of liability

To the maximum extent permitted by law, Gelotto will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost data or profits, arising from your use of the app. Our total liability for any claim relating to the app will not exceed the amount you paid for it in the twelve months before the claim arose.

10. Termination

These Terms apply for as long as you use Lexi-Defense. We may end your license if you materially breach these Terms. You can stop using the app at any time by deleting it.

11. Changes

We may update these Terms as the app evolves. Material changes will be posted on this page with a new effective date; continuing to use the app after a change means you accept the updated Terms.

12. Governing law

These Terms are governed by the laws of the United States and the state of Gelotto's principal place of business, without regard to conflict-of-law rules, except where the law of your place of residence requires otherwise.
